Indecent Sexposure: Sex In Public Is A Top Sexual Fantasy

It’s that time of year again, when hearts flutter, and people want to get it on in a public place. Having sex in public consistently comes in as the number three sex fantasy in most sex surveys. (It trails behind “having a threesome” and “having sex with my wife’s best friend,” which sounds so hilariously wrong.)

In recent months, the news has reported more arrests for public sex than ever before. Psychologically, it’s the fear of getting caught that makes it so sex-citing. A 20-something couple who just met on a Virgin Atlantic flight were caught joining the Mile High Club in the bathroom, then banned from ever flying Virgin again. This week, a 40-something couple was arrested, caught by a Roman Catholic priest for having sex in the church. And from the “get a life department,” a 24-year-old man in Kansas was arrested two weeks ago for having sex with a car exhaust pipe. He was charged with “lewd and lascivious” behavior. The exhaust pipe will never be the same. And from now on “banana in an exhaust pipe” is a new expression.

So if you do get caught, what are the charges and the consequences? According to Clay White of criminaldefenselawyer.com ‘“indecency” or “lewdness” usually includes an element of lustful or sexual indulgence on the part of the defendant. For example, engaging in sexual intercourse in a public place definitely satisfies the requirement. Other public sexual acts may also fall within the definition of lewd or indecent behavior.” Like a blow job.

“The level of sexual contact required, if any, varies by state,” says White. The exposure of private body parts, known as “flashing” or exhibitionism,” he says (big on the subways in NYC), “also constitutes lewd behavior in some states.” The defense on this one could be “lack of intent to act publicly,” says White, which means someone could flash his weenie on the subway and could just say he was urinating on the subway, or worse, just taking a dick pic selfie to send to some poor girl on Tinder.

Doing it in a car is the number one favorite public place to do some “backseat driving.” Sexual activity inside an automobile that is visible to someone outside the automobile constitutes lewd behavior.

The charges are misdemeanors, and most people end up with a small fine, or community service at the most. So to anyone considering have sex in a public place, we’ll be watching you.
